GAPPED ONLINE LIMITED TRACK TIME TOURNAMENT – TERMS & CONDITIONS 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 

1. Key Tournament Particulars

1.1 Prize: The winner will be awarded one (1) BMW M3 CS (2018) (the “Prize Vehicle”). 

1.2 Cash Alternative: In lieu of the Prize Vehicle, the winner may elect to receive a cash payment of fifty thousand euros (€50,000). 

1.3 Tournament Period: The Tournament shall commence at 13:00 Central European Time (CET/CEST) on 24 July 2026 and shall close at 23:00 Central European Time (CET/CEST) on 13 September 2026.  

1.4 Maximum Competitors: Participation is limited to a total of 5,999 valid Competitors. The draw will take place regardless of the number of tickets sold.  

1.5 Draw Date: The draw will take place within seven (7) calendar days after the Closing Date (Section 1.3). If circumstances beyond the Sponsor’s reasonable control require postponement, the draw may be rescheduled once by up to a further seven (7) calendar days.

 

2. Sponsor Information

2.1 The sponsor of the Gapped Online Limited Track Time Tournament (the “Tournament”) is Gapped Online Limited (“Sponsor”), a company incorporated and operating under the laws of the United Kingdom. The Sponsor assumes sole responsibility for the administration, management, and execution of the Tournament.

2.3 All correspondence or inquiries related to the Tournament should be directed to the above contact details and will be responded to during normal business hours (Monday to Friday, 10:00 AM to 6:00 PM Central European Time (CET/CEST), excluding public holidays.

3. Eligibility Criteria

3.1 Competitor Eligibility: For the purposes of these Terms & Conditions, a “Competitor” means an individual person who submits a valid Tournament entry in accordance with Section 4 (Entry Methods). The Tournament is open exclusively to Competitors who:   

  • Are legal residents of jurisdictions where participation in skill-based competitions is permitted by law, including but not limited to the United Kingdom, Germany, and other European Union member states. Participation from jurisdictions where such activities are prohibited or restricted is expressly disallowed.
  • Have attained the age of majority in their jurisdiction of residence (generally 18 years or older, but this may vary by country). Proof of age will be required if requested.
  • Have full legal capacity to enter into binding contracts and agree to be legally bound by these Terms & Conditions.

3.2 Legal Compliance: Competitors are responsible for ensuring that their participation complies with all laws and regulations that apply to them in their country or place of residence, including (where relevant) those relating to skill-based competitions, advertising, consumer protection, and taxation.  

3.3 Verification Requirements: The Sponsor reserves the right to request and verify a Competitor’s identity, residency, and age through official government-issued identification or other acceptable documentation. The Sponsor may also require additional steps to confirm that the individual providing the identification is the same person as named on the documents, which may include, for example, electronic identity checks or other reasonable validation methods. Competitors must complete any requested verification within seven (7) calendar days of the Sponsor’s request. Failure or refusal to provide or complete the requested verification within this timeframe may result in disqualification and forfeiture of any prizes.  

3.4 Exclusions: The following persons, or groups of persons, are excluded from participation in the Tournament, including but not limited to:

  • Employees, officers, and directors of the Sponsor;
  • Agents and contractors engaged by the Sponsor in connection with the Tournament;
  • Employees, officers, and representatives of the Sponsor’s subsidiaries, affiliates, advertising, or promotional agencies; and
  • Immediate family members (spouse, partner, parent, child, sibling) and members of the same household of any of the foregoing individuals, whether related or not.

The Sponsor’s determination as to whether an individual falls within an excluded category shall be final, binding, and not subject to challenge.

3.5 Competitor Limits (Tournament Size): The Tournament is limited to the maximum total of Competitors specified in Section 1.4. Once this threshold has been reached, no further Competitors will be accepted, and the Sponsor may close registration early without prior notice.

3.6 Disqualification: The Sponsor reserves the right, at its sole discretion, to disqualify any Competitor and to declare any entry void where it reasonably believes that the Competitor has:

  • engaged in fraudulent, dishonest, or deceptive conduct of any kind;
  • breached these Terms & Conditions or failed to comply with any lawful instructions issued by the Sponsor; 
  • tampered with, interfered with, or manipulated the entry process, the operation of the Tournament, or any related system, platform, or technology (including but not limited to automated entries, bots, or scripts);
  • colluded, conspired, or acted in coordination with other individuals or groups to obtain an unfair advantage;
  • engaged in abusive, threatening, or harassing behaviour toward the Sponsor, its representatives, or other Competitors;
  • acted in any manner that is unlawful, unethical, or detrimental to the fairness, integrity, or proper conduct of the Tournament; or
  • taken any action that, in the opinion of the Sponsor, is likely to damage the reputation, goodwill, or public perception of the Tournament or the Sponsor.

The Sponsor’s decision to disqualify a Competitor under this Section shall be final, binding, and not subject to appeal or challenge.

4. Entry Methods

NO PURCHASE NECESSARY TO ENTER OR WIN.

4.1 Overview: Entry into the Tournament is obtained through a valid Lap Time Prediction (each a “Prediction”).

For online and app-based entries, a Prediction will be automatically and randomly generated and assigned to the Competitor upon successful entry (including payment where applicable).

Competitors may then review, edit, and confirm their assigned Prediction within any permitted amendment window specified by the Sponsor.

For postal entries, the Prediction must be provided at the time of submission.

Predictions may be submitted by the following methods:

a) Free Postal Entry (No Purchase Necessary)

Entrants who, for any reason (including but not limited to personal preference, connectivity limitations, or a desire to utilise a non-digital pathway), choose not to use the streamlined and immediate Online Entry route may, if they so wish, participate in the Tournament by means of the Free Postal Entry method described below. This method is available to eligible individuals and is designed to ensure fairness and equal opportunity, yet it requires careful attention to instructions, precise formatting, and strict adherence to the applicable deadlines. Please read the following guidance in full before attempting to submit a postal entry to avoid inadvertent invalidation.   

How to submit your Free Postal Entry (format and addressing):  Your free entry must be posted on an unenclosed postcard (i.e., not in an envelope and not otherwise enclosed) of sufficient durability to withstand postal handling. The postcard must be addressed clearly and legibly to the Sponsor at the exact address shown below. To minimise the chance of misdirection by postal services, we recommend writing the address in block capitals and ensuring all lines are included exactly as presented:

What to include on the postcard (mandatory fields):  For an entry to be considered valid, the postcard must clearly set out, in a legible manner, all of the following details. Omission of any item, or presentation in a way that is illegible or ambiguous, may lead to disqualification without notice:  

  • Your full name (first name and surname).
  • Your date of birth (DOB)
  • Your full address (including town/city, postcode, and country of residence).
  • A contact telephone number and an email address that you actively monitor.
  • The phrase “Gapped Giveaway #10 – Free Entry Request”
  • Exactly one (1) Lap Time Prediction in the exact format 00:00:000 (minutes:seconds:milliseconds). Please ensure that your prediction strictly follows this format and contains no additional symbols or annotations.

Illegible or incomplete postcards:  Entries that are incomplete or illegible will be disqualified. This includes postcards where handwriting, print quality, or layout makes it difficult to accurately determine the required information or your lap time prediction. The Sponsor is not responsible for any issues arising from smudging, fading, or damage to the postcard during transit.   

Multiple entries and bulk submissions:  You may make multiple free entries (up to any limit placed by the Sponsor); however, each entry must be submitted separately, on its own individual postcard, and posted to the Sponsor separately. Bulk entries will not be accepted as multiple entries; if a bulk entry is received, it will be counted as one single entry irrespective of the number of predictions contained or the number of postcards bundled together.   

Confirmation of eligibility and acceptance of terms:  By entering the competition via the Postal Entry Route, you confirm that you are eligible to enter and that you accept these Terms & Conditions in full. You also confirm that the information you provide is accurate and current, and that you understand the conditions under which postal entries are processed and validated.   

Closing Date and timeliness of receipt:  Your entry must be received by the Sponsor prior to the Closing Date. Please note that entries received after the Closing Date will not be entered, regardless of the date of posting or any postal delays outside your control. You are advised to post your entry in good time and to consider typical delivery times when submitting close to the deadline.   

Entry confirmation:  For each valid entry received via the Postal Entry Route that meets all the above criteria, the Sponsor will send an email to the Competitor confirming receipt of that entry. If you do not receive such confirmation within a reasonable period, this may indicate that your entry was not received or was invalid; you may wish to review the requirements above and resubmit if time permits and if you remain within any applicable entry limits.   

b) Gapped Online Application – Paid Subscription:  Competitors subscribed to the Sponsor’s Gapped Online mobile application Pro Tier service may submit a designated number of Predictions per subscription period. The specific number, validity period, and terms will be published in the app and related materials.   

c) Direct Purchase:

Competitors may purchase entries directly from the Sponsor via the official online store (https://gapped.shop) and/or the Gapped Online mobile app.

Upon successful payment, a randomly generated Prediction will be automatically assigned to the Competitor. This constitutes a valid entry into the Tournament.

Competitors may review, edit, and confirm their assigned Prediction within any amendment window specified by the Sponsor.

If a Competitor does not edit or confirm their Prediction, the automatically assigned Prediction will be deemed final and will be used as their entry.

No further action is required for an entry to remain valid.

If payment is not completed or is reversed/refunded, the associated entry will be voided and will not be included.

Pricing and any per-transaction limits will be disclosed at the point of sale. To the fullest extent permitted by law, fees for submitted entries are non-refundable.

d) Promotional Activities: From time to time, the Sponsor may allow submission of Predictions at no cost via promotional campaigns (e.g., social sharing, referrals, in-app challenges). Terms for each promotion will be published and must be followed.

4.2 Clarification: Predictions are entries in a skill-based Tournament and have no monetary or intrinsic value outside of the Tournament. Predictions—whether submitted via free post, subscription, direct purchase, or promotion—cannot be redeemed, transferred for value, or exchanged for cash or goods.

4.3 Registration and Non-Transferability: Each Prediction is linked to the Competitor’s email address and/or user account and may be associated with the Competitor’s mobile phone number. Predictions are strictly non-transferable between accounts or individuals. The Sponsor may conduct verification checks prior to accepting or validating any Prediction.

4.4 Multiple Entries: Competitors may submit multiple Predictions where and as allowed by the methods above. Each Prediction constitutes a separate Tournament entry.

4.5 Entry Requirements: Each entry must be a prediction of the official Target Lap Time (“Target Lap Time”). Predictions may be automatically generated by the Sponsor’s system or manually edited by the Competitor. All Predictions must conform to the required format: 00:00:000 (minutes:seconds:milliseconds).

4.6 Submission Deadline:All entries must be paid for before the closing date and time set out in Section 1.3.

Any edits or modifications to assigned Predictions must be completed within the amendment window and before any final submission cutoff specified by the Sponsor.

Predictions (whether automatically assigned or edited) will be treated as final after the applicable cutoff.

4.7 Edits & Finality: For online and app-based entries, a Prediction will be automatically assigned upon entry. Competitors may review, edit, and confirm their Prediction within any amendment window specified by the Sponsor. If no changes are made within this period, the automatically assigned Prediction will be deemed final. Competitors are not required to edit or modify their assigned Prediction for their entry to remain valid. For postal entries, Predictions are final upon receipt and cannot be edited.

5. Prize & Winner Responsibilities

5.1 Prize Description: The Prize shall be as described in Section 1.1. The Prize details, specifications, and conditions are final and subject to availability.   

5.2 Cash Alternative: The winner may elect to receive the Cash Alternative described in Section 1.2. The Sponsor reserves sole discretion in determining payment methods, timing, and any associated fees (including any currency conversion where applicable).   

5.3 Prize Condition: The Prize is provided “as-is” with no express or implied warranties, guarantees, or representations by the Sponsor regarding quality, condition, merchantability, or fitness for purpose. The Sponsor expressly disclaims any liability for defects, damages, or issues related to the Prize after delivery or transfer of ownership.   

5.4 Winner Responsibilities: The winner is responsible for all costs and expenses associated with the Prize, including but not limited to: insurance premiums and coverage requirements; applicable taxes, customs duties, import/export fees, and other governmental levies; vehicle registration, licensing, and compliance with local laws; maintenance, repairs, and upkeep; and transportation, delivery, or shipping costs where applicable.   

5.5 Declination of Prize: If the winner declines to accept the Prize described in Section 1.1, the Cash Alternative described in Section 1.2 may be offered, but no other substitutions, exchanges, or compensations will be provided.   

5.6 Non-Transferability: The Prize is strictly non-transferable and may not be sold, assigned, or otherwise conveyed except as expressly permitted by the Sponsor. If the Prize remains unclaimed or the winner is ineligible, the Sponsor will select an alternate winner as outlined in Section 6.   

5.7 Tax & Legal Advice: The Sponsor does not provide tax, legal, or financial advice. Winners should consult their own professional advisors to understand and comply with all relevant obligations arising from receipt of the Prize. 

 

6. Winner Selection & Notification

6.1 Winner Determination: The winner will be the Competitor whose submitted Prediction is closest to the official Target Lap Time (measured to the nearest thousandth of a second, 0.001s). “Closest” means the smallest absolute difference between a Prediction and the official Target Lap Time. If a Prediction exactly matches the Target Lap Time, that Competitor shall rank first. All times and differences are calculated to 0.001s using standard rounding (0.0005 rounds up).  

6.2 Tie-Break Procedure: In the event of a tie – where multiple Competitors’ Predictions are equally close to the Target Lap Time  all tied Competitors will be requested to submit a new prediction within seven (7) calendar days for an additional decider lap provided by the Sponsor. The Competitor whose tie-break prediction is closest to the verified time of the decider lap will be declared the winner. If a tie persists, further decider laps and predictions may be required until the tie is resolved. Any Competitor who fails to submit a new prediction within the seven (7) calendar day period will be disqualified. 

6.3 Winner Notification: The Sponsor will notify the selected winner via the email address or telephone number provided upon entry. The winner must respond and confirm acceptance of the Prize within seven (7) calendar days from the date of initial contact.   

6.4 Forfeiture and Alternate Winners: If the winner does not respond within the specified timeframe, declines the Prize, or is determined to be ineligible or in breach of these Terms, the Prize will be forfeited. The Sponsor will then select an alternate winner using the same selection method. This process will continue until a valid winner is confirmed.   

6.5 Communication Disclaimer: The Sponsor is not responsible for any failure of delivery of notification due to incorrect or outdated contact details provided by Competitors or technical issues beyond the Sponsor’s control.   

6.6 Tournament Dates: The Tournament shall be conducted during the Tournament Period specified in Section 1.3These dates and times may be amended where reasonably necessary due to operational, technical, or legal requirements. Any changes will be communicated promptly through the Sponsor’s official channels.

 

7. General Terms & Conditions

7.1 No Purchase Necessary & No Advantage from Purchase: A purchase does not increase the likelihood that any particular Prediction will win; purchasing only increases the number of entries a Competitor may submit. Each entry is judged solely on the accuracy of its Prediction.   

7.2 Publicity Release: By entering, Competitors grant the Sponsor and its agents the right to use their name, likeness, image, voice, and statements for promotional and marketing purposes without additional compensation, except where prohibited by law.   

7.3 Limitation of Liability: To the maximum extent permitted by law, the Sponsor, its affiliates, and agents disclaim all liability for any loss, damage, injury, or disappointment arising out of participation or acceptance/use of the Prize.   

7.4 Privacy & Data Protection: Competitor personal data—including name, date of birth, country, mobile number, email address and Prediction(s)—will be collected, processed, and stored in accordance with applicable data protection laws and the Sponsor’s privacy policy, available at https://gapped.shop/privacy-policy. Contact details will be used for verification and winner notification.   

7.5 Nature of the Competition: This Tournament is a game of skill. The outcome is determined solely by the Competitor’s ability to accurately predict the Target Lap Time based on the published Slow Reference Lap Time and Fast Reference Lap Time, together with disclosed simulator parameters. The Tournament is not a lottery, sweepstake, or game of chance.   

7.6 Dispute Resolution: 

(a) Mandatory Informal Resolution Period 
If a Competitor has any complaint, claim, or dispute arising out of or in connection with the Tournament or these Terms & Conditions, the Competitor must first contact the Sponsor in writing at support@gapped.online, providing full details of the issue. 

The parties shall use reasonable efforts to resolve the dispute amicably within thirty (30) calendar days of the Sponsor’s receipt of the written notice. No formal proceedings may be commenced until this 30-day period has expired, unless urgent interim relief is required. 

(b) Binding Arbitration 
Subject to paragraph (d) below, any dispute, controversy, or claim arising out of or relating to the Tournament or these Terms & Conditions, including any question regarding their existence, validity, interpretation, or termination, shall be referred to and finally resolved by arbitration under the Arbitration Act 1996 (UK). 

The arbitration shall be conducted under the Rules of the London Court of International Arbitration (LCIA) in force at the time the Notice of Arbitration is submitted. The seat of arbitration shall be London, England. The language of the arbitration shall be English. The tribunal shall consist of one arbitrator. 

The arbitrator’s award shall be final and binding on the parties and may be enforced in any court of competent jurisdiction. 

(c) Confidentiality 
The existence of the arbitration, all materials submitted, and any award issued shall remain confidential, except as required by law or for the purposes of enforcement. 

(d) Consumer Rights Safeguard 
Nothing in this Section shall limit or exclude any mandatory statutory rights of a Competitor who qualifies as a consumer under applicable law. Where applicable law entitles such a Competitor to bring proceedings before the courts of their country of habitual residence, this clause shall not operate to prevent the exercise of that right. 

(e) Interim Relief 
Nothing in this Section prevents either party from seeking urgent interim or injunctive relief from the courts of England and Wales where necessary to protect its rights pending the outcome of arbitration.  

7.7 Sponsor’s Final Decision: All decisions made by the Sponsor regarding eligibility, compliance with these Terms & Conditions, the validity of entries, disqualification, and the determination of winners shall be final and binding in the absence of manifest error or fraud. 

 

8. Transparency & Verification Protocol

8.1 Driver, Car, Track & Simulator Parameters: All official simulator laps (including the Slow Reference Lap, Fast Reference Lap, the Target Lap, and any tie-break laps) will be completed by the same appointed driver on the same track and simulator platform. 

Prior to completion of the Target Lap and before the opening of the entry period, the Sponsor will disclose: 

  • • The Slow Car, Fast Car, and Middle Car; 

  • • The track configuration; 

  • • The identity of the driver; and 

  • • The relevant simulator parameters (including but not limited to weather settings and track conditions).


The disclosed parameters will not be materially altered between their publication and completion of the Target Lap.

8.2 Timing & Recording: Each lap will be electronically timed and video recorded. The official lap times will be measured and recorded to the nearest thousandth of a second (00:00:001s).   

8.3 Publication of Reference Lap Times: The Sponsor will publish the videos and official times of the Slow Reference Lap (in the Slow Car) and the Fast Reference Lap (in the Fast Car) before or at the opening of the entry period, to provide bookends for Competitors’ estimations. All three cars are driven by the same driver on the same track and simulator configuration.  

8.4 Determination of Target Lap Time: Prior to the opening of the Tournament entry period, the Sponsor will complete one (1) official Middle Car lap under the conditions described in this Section 8. The lap will be electronically timed and recorded in full. The official lap time, measured to the nearest thousandth of a second (0.001s), shall constitute the “Target Lap Time.” 

The Target Lap and its official time will remain confidential until the scheduled livestream reveal. The date and scheduled start time of the livestream will be announced prior to the Closing Date. 

In the event of technical disruption affecting the livestream broadcast, the validity of the previously recorded Target Lap and its official time shall not be affected. The Sponsor will publish the full uninterrupted lap recording as soon as reasonably practicable. 

8.5 Verification & Publication of Results: After winner determination and Prize award, the Sponsor will publish the official Target Lap Time together with the full lap video and sufficient supporting information to allow independent verification of the recorded time measurement process. 

8.6 Tie-Break Laps: If required under Section 6.2, one or more additional laps will be completed under comparable parameters. Their official times will be recorded to the nearest 0.001s, retained confidentially until tie-break predictions are submitted, and then disclosed after determination. 

8.7 Integrity of Timing Data: The electronically recorded simulator timing data shall constitute the sole official time record for all laps. Video overlays, broadcast graphics, or third-party platform displays are illustrative only and do not override the official recorded timing data.

 

9. Winner Announcement

9.1 The winner’s full name will be published on the Sponsor’s website, social media platforms, and other marketing materials unless prohibited by law.

Because products are made to order, we cannot issue refunds, returns, or exchanges for orders except for those with quality issues. Orders are non-refundable unless they meet these requirements and you provide support with a photograph demonstrating the quality issue. 

DAMAGED/QUALITY ISSUES

For the fastest resolution, please include a photograph demonstrating the quality issue of the print or the damaged area of the item, along with your order number. The most optimal pictures are on a flat surface, with the tag and error clearly displayed.

Anti Money Laundering Policy

1.1 On top of complying with all conditions in relation to prize competitions, Gapped Online Limited has put in place measures to prevent its systems from being used for the purposes of money laundering, terrorist financing or any other criminal activity.

1.2 Gapped Online Limited is committed to preventing money laundering and combat the financing of terrorism in order to minimise and manage its reputational risk, legal risk and regulatory risk. It is also committed to its wider social responsibility in preventing crime by not allowing its systems to be used to commit crimes.

1.3 Take reasonable steps to establish the identity of any person for whom it is proposed to provide its service.

1.4 Keep at all times a secure online list of all registered Players.

1.5 Retain identification and transactional documentation for each Player.

1.6 Provide initial and ongoing training to all relevant staff so that they are aware of their personal responsibilities and the procedures in respect of identifying Players, monitoring Player activity, record-keeping and reporting any unusual/suspicious transactions.

1.7 Ensure that this policy is reviewed and maintained regularly.

1.8 Examine, as much as is possible, the background and purpose of any complex or large transactions or groups of transactions which are likely, by their nature, to be related to money laundering or the funding of terrorism.

1.9 Not accept or open anonymous Accounts or Accounts in fictitious names such that the true beneficial owner is not known.

1.10 Not register a Player who is under eighteen (18) years of age.

1.11 Only register a single account in the name of a particular person.

1.12 Transfer payments of winnings or refunds back to the same route from where the funds originated, where possible.

1.13 Not accept cash from Players. Funds may be received from Players only by any of the approved methods.

1.14 Terminate a Player’s registration if it becomes aware that a person has provided false information when onboarding.

1.15 Report any suspicion or knowledge of money laundering of terrorism financing to the authorities.

1.16 Cooperate with all relevant administrative, enforcement and judicial authorities in their endeavour to prevent and detect criminal activity.
